Se Forma Coalición nacional para defender DACA

Washington, DC April, 2018 – Una coalición de organizaciones de derechos civiles y de justicia social a cargo del Comité Nacional de Juristas para los derechos civiles presentó una demanda ante la segunda corte de Apelaciones a favor de los demandantes en dos casos relacionados, el estado de Nueva York vs Donald Trump la cual desafía a Presidente Trump poner fin a la acción diferida para los programa de llegados en la infancia (DACA)
"DACA ha permitido a miles de jóvenes a perseguir oportunidades significativas y obtener seguridad económica." dijo Dariely Rodríguez, Director del Comité de abogados y protección de los derechos civiles bajo la ley de justicia económica (en inglés- Director of the Lawyers’ Committee for Civil Rights Under Law’s Economic Justice Project. «La decisión arbitraria de la administración para terminar DACA es ilegal y hecha sin tener en cuenta las familias afectadas, las comunidades y nuestra economía. Seguiremos defendiendo a los soñadores en los tribunales al desafiar las políticas discriminatorias de la administración."
Estos casos están en apelación en el distrito oriental de Nueva York, donde el 13 de febrero de 2018, juez Nicholas Garaufis emitió una orden a nivel nacional, ordena al Departamento de seguridad nacional continuar la tramitación de las solicitudes de renovación para DACA para actual receptors, pendiente el caso de ser escuchados por sus méritos. Esta decisión siguió el mandato a nivel nacional emitido por el juez William Alsup en el distrito norte de California, en una acción similar de DACA el 09 de enero de 2018.
Siete organizaciones de derechos civiles a cargo del Comité de abogados por los derechos civiles bajo la ley están tratando de asegurarse de que la Corte considere que la administración no esta considerando el efecto perjudicial que el terminar el programa DACA tendría en estos jóvenes y sus comunidades.
El escrito se centra en la indiferencia de la administración en forma arbitraria y caprichosa para reinvertir programas que crean dependencia de intereses de inversión. El escrito analiza la falta de la administración a considerar las maneras en que los afiliados se basaron en el programa DACA destacando las inversiones que han hecho en ellos mismos y sus comunidades, tales como inscribirse en colegios y programas de capacitación de trabajo, compra de hogares y unirse a las fuerzas armadas.
Además el Comité de abogados por los derechos civiles, se unieron: Advocates for Youth, Anti-Defamation League, Lawyers’ Committee for Civil Rights and Economic Justice, Mississippi Center for Justice, Southern Poverty Law Center, and Washington Lawyers’ Committee for Civil Rights and Urban Affairs. The brief was filed with pro bono counsel Venable LLP.


Advocates for Youth Joined National Coalition in  Effort to defend recipients of DACA

“Coalition of National Civil Rights Organizations Files Circuit Court Amicus Brief In Support Of Challenge to
Trump Administration’s Move To Abruptly End DACA Program”

Washington, DC April, 2018 .- A coalition of civil rights and social justice organizations led by the national Lawyers’ Committee for Civil Rights Under Law filed an amicus brief before the Second Circuit Court of Appeals in support of plaintiffs in two related cases, State of New York et al. v. Donald Trump and Batalla Vidal, et al. v. Baran, et al, which challenge President Trump’s move to end the Deferred Action for Childhood Arrivals (DACA) program.
“DACA has allowed thousands of young people to pursue meaningful opportunities and obtain economic security.” said Dariely Rodriguez, Director of the Lawyers’ Committee for Civil Rights Under Law’s Economic Justice Project. “The administration’s arbitrary decision to terminate DACA was unlawful and made without regard to impacted families, communities and our economy. We will continue to stand up for Dreamers in the courts by challenging this Administration’s discriminatory policies.”
These cases are on appeal from the Eastern District of New York, where on February 13, 2018, Judge Nicholas Garaufis issued a nationwide injunction, ordering the Department of Homeland Security to continue processing renewal applications for current DACA recipients pending the case being heard on its merits. This decision followed the nationwide injunction issued by Judge William Alsup in the Northern District of California in a similar DACA action on January 9, 2018.
In filing an amicus brief in State of New York et al. v. Donald Trump and Batalla Vidal, et al. v. Baran, et al, seven civil rights organizations led by the Lawyers’ Committee for Civil Rights Under Law are seeking to ensure that the court considers the administration’s failure to consider the detrimental effect that rescinding the DACA program would have on enrollees and their communities.
The brief focuses on the administration’s disregard for the Administrative Procedure Act’s limitation on arbitrarily and capriciously reversing programs that create reliance interests. The brief examines the administration’s failure to consider the ways that enrollees relied on the DACA program by highlighting the investments they have made in themselves and their communities, such as enrolling in colleges and job training programs, purchasing homes and joining the military.
In addition to the Lawyers’ Committee for Civil Rights Under Law, the brief is joined by: Advocates for Youth, Anti-Defamation League, Lawyers’ Committee for Civil Rights and Economic Justice, Mississippi Center for Justice, Southern Poverty Law Center, and Washington Lawyers’ Committee for Civil Rights and Urban Affairs.
