USCIS actualiza la guía para la clasificación de estudiantes no inmigrantes F/M
Estamos actualizando la guía en el Manual de Políticas de USCIS con respecto a cuándo los estudiantes pueden ser elegibles para extensiones de capacitación práctica opcional (OPT) para los campos de Ciencia, Tecnología, Ingeniería y Matemáticas (STEM). Esta guía, que se encuentra en el Volumen 2, Parte F, del Manual de Políticas, también proporciona orientación aclaratoria para los estudiantes no inmigrantes femeninos y masculinos con respecto al estudio en línea, las transferencias escolares, el período de gracia y los estudios en el extranjero.
Actualización del Manual de Políticas:
• Aclara que los estudiantes pueden contar una clase o tres créditos (o el equivalente) por sesión académica (o el equivalente) para un curso completo de estudio si toman la clase en línea o a distancia sin requerir asistencia física para ningún propósito integral a la finalización de la clase.
• Explica que los estudiantes pueden transferirse entre el Servicio de Inmigración y Control de Aduanas de los Estados Unidos (ICE, por sus siglas en inglés), escuelas certificadas por el Programa de Estudiantes y Visitantes de Intercambio (SEVP, por sus siglas en inglés), escuelas del mismo nivel educativo, o moverse entre niveles educativos.
• Explica que, durante el período de gracia de 60 días después de un período autorizado de posgrado posterior a la finalización de OPT, los estudiantes pueden cambiar su nivel de educación, transferirse a otra escuela certificada por SEVP o presentar una solicitud o petición ante USCIS para cambiar a otro estatus de no inmigrante o inmigrante.
• Aclara que los estudiantes pueden ser elegibles para OPT posterior a la finalización después de completar un programa de grado asociado, licenciatura, maestría o doctorado.
• Corrige el período durante el cual los estudiantes pueden solicitar extensiones de STEM OPT y realiza otras correcciones técnicas.
• Aclara que un estudiante inscrito en una escuela certificada por SEVP durante un programa de estudios en el extranjero puede permanecer activo en el Sistema de Información de Estudiantes y Visitantes de Intercambio si el programa de estudios en el extranjero dura menos de cinco meses, pero que el estudiante necesitará un nuevo Formulario I-20, Certificado de Elegibilidad para el Estatus de Estudiante No Inmigrante, si el programa dura más de cinco meses.
Esta guía entra en vigencia de inmediato y se aplica a las solicitudes pendientes o presentadas en o después de la fecha de publicación.
