OKLAHOMA CITY – El representante Chad Caldwell, republicano por Enid, elogió la aprobación de la Cámara de Representantes de un proyecto de ley que, según dijo, pondría fin a la discriminación patrocinada por el estado contra las familias de Oklahoma con estudiantes con necesidades especiales.
El Proyecto de Ley Senatorial 105 modificaría los requisitos de elegibilidad para estudiantes que forman parte del Programa de Becas Lindsey Nicole Henry para Estudiantes con Discapacidades.
"Esta legislación elimina las barreras discriminatorias que enfrentan solo los estudiantes con necesidades especiales o discapacidades", dijo Caldwell. "Las familias de los estudiantes tradicionales pueden acceder a los fondos de elección de escuela desde el primer día. Sin embargo, hasta ahora, hemos puesto obstáculos adicionales frente a los niños con necesidades especiales, haciéndolos esperar para acceder a servicios y adaptaciones que satisfagan mejor sus necesidades específicas".
La SB105 elimina el requisito de que un estudiante asista a un distrito escolar público el año anterior a solicitar el programa. El proyecto de ley también elimina el lenguaje que establece que la aceptación de una beca tiene el mismo efecto que la revocación del consentimiento de los padres a los servicios bajo ciertas disposiciones de IDEA, lo cual no está permitido por el código federal. La medida también aclara que los estudiantes en un programa de educación individualizado (IEP), un plan de servicio individualizado (ISP) o que cumplen con los estándares de elegibilidad para servicios de educación especial de acuerdo con IDEA son elegibles para participar en la beca.
La senadora Julie Daniels (R-Bartlesville) es la autora del proyecto de ley en el Senado.
"Esta legislación nivela el campo de juego para las familias de niños con discapacidades o necesidades especiales", dijo Daniels. "Ningún padre debería tener que mantener a su hijo en una escuela que no está funcionando para ellos solo para esperar un requisito arbitrario de un año para calificar para la ayuda financiera. El Proyecto de Ley Senatorial 105 asegura que las familias puedan acceder a la Beca Lindsey Nicole Henry sin demoras innecesarias, dándoles la flexibilidad de elegir el entorno educativo de mayor apoyo desde el principio".
El programa de becas Lindsey Nicole Henry autoriza al padre o tutor de un estudiante de una escuela pública con una discapacidad que recibe servicios bajo la Ley de Educación para Personas con Discapacidades (IDEA) a ejercer su opción parental y solicitar que se otorgue una beca LNH para que su hijo asista a una escuela privada participante aprobada por la Junta Estatal de Educación. El programa ha estado en marcha desde 2011 y actualmente atiende a unos 1.500 estudiantes.
Otros estudiantes elegibles incluyen a estos:
• que tienen un Plan de Servicio Individualizado desarrollado por el Departamento de Servicios Humanos (DHS);
• que es hijo de una familia militar con órdenes de cambio permanente de estación y que se ha mudado a Oklahoma.
• que han estado en colocación fuera del hogar a través de la oficina de Asuntos Juveniles; o
• que han estado en colocación fuera del hogar con DHS, o que fueron adoptados mientras estaban bajo custodia permanente de DHS.
Los fondos de las becas se pagan en incrementos directamente a las escuelas participantes, no a los padres, y solo después de que los estudiantes hayan asistido a la escuela.
La SB105 fue aprobada por la Cámara de Representantes el martes con una votación de 70-23. Fue enmendada en la Cámara de Representantes, por lo que ahora regresa al Senado para su consideración final.

El Senador Sacchieri presentó esta semana la Resolución Senatorial 18 (SR18), reafirmando el derecho de los residentes de Oklahoma a optar por no participar en el programa federal REAL ID bajo los principios del federalismo protegidos por la Décima Enmienda. La resolución insta al estado a garantizar una elección significativa entre las opciones de identificación que cumplen con REAL ID y las que no lo son, particularmente salvaguardando los datos personales y biométricos del acceso federal injustificado.
La SR18 plantea preocupaciones sobre la recopilación y retención de información biométrica confidencial, como los datos de reconocimiento facial, necesarios para las licencias de conducir y tarjetas de identificación que cumplen con REAL ID.
